Tailo is a service provided by Estendio Ltd (“we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of the Tailo services, which are accessible through our website at https://read.uk.tailoapp.com/ and https://read.us.tailoapp.com/ (“Website”). This includes all features, functionality, and content we offer through the Website (“Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from accessing or using the Service.

We reserve the right to modify these Terms at any time. Any changes will be posted on this page and the date of the last update will be indicated at the top. Your continued use of the Service after any changes are made will constitute your acceptance of the new Terms. We encourage you to review these Terms periodically to stay informed about any updates.

2. Definitions

Website: The Tailo software programme provided by Estendio Ltd.

Account: A unique account created for you to access our Service.

Company: Estendio Ltd, located at Office 1, Technology House, 9 Newton Place, Glasgow, G3 7PR.

Content: Text, images, or other information that you can post, upload, or otherwise make available via the Service.

Feedback: Any feedback, innovations, or suggestions provided by you regarding the Service’s features, performance, or attributes.

Service: The Website, including all features, functionality, and content we offer.

Third-party providers: External entities that assist in providing the Service, including but not limited to OpenAI, Amazon Web Services (AWS), Orq.ai, Mistral AI, and Elastic Cloud.

You: The individual or legal entity accessing or using the Service.

3. Service description and user obligations

3.1. Service description

Tailo is designed to enhance your digital reading experience by providing accessible and tailored content. With Tailo, you can upload documents to adjust formatting, access definitions, explanations and summaries, get personalised support with the conversational AI feature (Tailo Tutor), and listen to content using the read-aloud feature.

3.2. AI service expectations and data privacy

Accuracy and relevancy: Tailo leverages AI technologies to enhance your reading experience. As AI is still evolving, the outputs may not always be accurate, relevant, or appropriate. Users should review AI-generated content before relying on it for critical decisions. Tailo is not liable for any errors, inaccuracies, or potentially offensive language that may be generated by the AI.

Speed of service: While Tailo’s AI features aim to process requests swiftly, processing times can vary depending on content complexity, current demand, and external factors. While we strive to respond promptly, delays or errors may occur.

Data privacy: When you upload documents to Tailo, they may be processed by third-party providers, including OpenAI, Google Gemini, Amazon Web Services (AWS), Orq.ai and Mistral AI. Tailo utilises these third parties to process data and provide the requested services. For detailed information on how your document data is handled, please refer to OpenAI’s API Data Usage Policies, Gemini Apps Privacy Notice**,** AWS Data Privacy, Orq.ai Data Privacy and Mistral Data Privacy.

3.3. Word definition feature

The Tailo Service uses the Collins Dictionary for our word definition feature. Please note that Collins is solely responsible for the definitions provided. While we strive to ensure accuracy, there may be instances where definitions are not fully correct or up to date. By using this feature, you acknowledge that any information provided by the Collins Dictionary is beyond our control, and we are not liable for any inaccuracies or misunderstandings that may arise from its use.

4. User accounts

4.1. Account creation

To use Tailo, you must have authorised access provided by a reseller, organisation, or institution, or sign up directly with us. You must provide accurate and current information when creating an account. Failure to do so may result in the immediate termination of your account.

4.2. Registration obligations

You agree to maintain accurate and complete registration information. This data, along with other information about you, is governed by our Privacy Policy.

4.3. Account termination

We reserve the right to terminate or suspend your account at any time, especially in cases of breach of these Terms.

4.4. Institutional accounts

If you access Tailo through an institutional (such as a university pilot), that institution may manage your account and terminate access in line with their agreements with us.

5. Access and use of the service

5.1. Modifications to service

Tailo may modify or discontinue the Service at any time, with or without notice.

5.2. General practices regarding use and storage

We may set limits on usage, storage, or retention for operational reasons.

5.3. Read aloud feature usage limits

The read-aloud feature is capped per user; limits may vary.

5.4. Document upload limits and fair use policy

To maintain service quality, we may impose limits on the number or size of document uploads and take action if use exceeds fair use thresholds.

5.5. Conversational AI limits and fair use policy

Fair usage caps may be applied to the conversational AI feature (Tailo Tutor). This feature supports learning and comprehension and must not be used to complete academic tasks on your behalf.

6. User content

6.1. Your right to upload content

You retain ownership of any content you upload to the Service. You are responsible for ensuring that your content is legal, reliable, and appropriate.

6.2. Content restrictions

You are solely responsible for the content you upload and any activity under your account. We do not control user-posted content and are not liable for any errors, omissions, or damages resulting from such content.

6.3. Content backups

We do not guarantee that your content will be backed up or protected against loss. Whilst every effort is made to ensure your files are preserved and readily available to you, it is your responsibility to maintain a copy of your content independent of the Service.

6.4. File upload errors

We do not guarantee that your content will be uploaded or displayed correctly. While we strive to ensure accurate extraction and display of your files, content may occasionally be extracted or presented incorrectly. It is your responsibility to review the uploaded content to ensure it is accurate and meets your needs. We are not liable for any issues or damages resulting from such errors.

7. Third-party services

Tailo uses external APIs and services for delivery, including:

  • OpenAI for content explanation and summarisation
  • Amazon Web Services (AWS) for hosting and processing
  • Orq.ai and Google Gemini for conversational AI interactions
  • Mistral AI for document processing
  • Elastic Cloud for search functionality

    8. Intellectual property

    The Service and its original content, features, and functionality are and will remain the exclusive property of the Company, its subsidiaries, and licensors.

    The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

    Our trademarks may not be used in connection with any product or service without the prior written consent of the Company.

    9. Your feedback to us

    You assign all rights, title, and interest in any Feedback you provide to us.

    We comply with UK data protection laws for all UK users.

    FERPA

    For US institutional users, we act as a data processor under FERPA and process educational records only on the institution’s instructions.

    US state privacy laws

    Tailo complies with applicable U.S. state privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CPRA), the Colorado Privacy Act (CPA), and the Virginia Consumer Data Protection Act (VCDPA), where relevant. Tailo does not sell or share personal data.

    13. Limitation of liability

    To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

    Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so these limitations may not apply to you. In such cases, liability will be limited to the maximum extent permitted by law.

    14. “AS IS” and “AS AVAILABLE” disclaimer

    The Service is provided to you “AS IS” and “AS AVAILABLE”, with all faults and without any warranty of any kind, express or implied. To the maximum extent permitted by law, the Company, its licensors, and service providers disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any arising from course of dealing or usage of trade.

    We do not warrant that the Service will meet your requirements, achieve intended results, be compatible with other systems, operate without interruption, meet performance standards, or be error-free, nor that defects will be corrected. We make no guarantee regarding the accuracy, reliability, or currency of content, nor that the Service, servers, or communications are free of harmful components.

    Some jurisdictions do not allow certain warranty exclusions, so these limitations may not apply to you. In such cases, they will apply to the maximum extent permitted by law.

    15. Governing law

    These Terms are governed by the laws of the United Kingdom. Your use of the Service may also be subject to other local, state, national, or international laws, including the laws of the jurisdiction in which you reside.

    United States Export Compliance

    You confirm that you are not located in, or a resident of, any country subject to a United States government embargo, and are not on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable U.S. export and re-export control laws and regulations, including the Export Administration Regulations (EAR) and relevant sanctions programs, and not to export, re-export, transfer, or release any part of the Service to any country, person, or entity prohibited under these laws.

    EU Users

    If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of your country of residence, which will apply in addition to these Terms.
